Definitions
ServerCity, LLC. agrees to furnish services to the Subscriber, subject to the following ("Terms of Service"). ServerCity, LLC., the company here after referred to as, ("ServerCity"), ("Us"), ("We") and The Client, ("Customer"), ("Client") and ("You"). Use of ServerCity Hosting Services constitutes acceptance and agreement to ToS ("Terms of Service"). All provisions of this contract are subject to change from time to time at the discretion of ServerCity. Hosting Subscriber understands that change to the ToS by ServerCity, LLC. shall not be grounds for early contract termination or non-payment.

Privacy Policy
Refunds and Disputes
All hosting service orders placed by newly registered customers are eligible for refunds within 48 hours of the creation of the server in our database, this point is not marked by the time at which your initial payment is processed and may differ by several hours or days. All refunds are made through the gateway in which initial payments were made. All of our other services, including product addons and dedicated servers and account credit are not eligible for a refund. Refunds cannot be requested without probable cause; in addition to this non-monthly terms are non-refundable. Our 48-hour money back guarantee applies to a new client's first order only. To request a refund, you must submit a refund request via the support ticket system outlining the reason. If you meet the terms of eligibility, a refund will be issued by a team member. Refunds will not be issued automatically. Refunds issued for billing errors are made on a per case basis.
Cancellations
To terminate your services you must cancel via our WHMCS billing area at https://billing.servercity.co/ using the cancellation request form. A cancellation request must be submitted when a client wishes to no longer proceed with their service or not to pay the invoice. Accounts with a credit card on file may automatically attempt to renew until cancelled. Unless specified per special arrangement, we do not hold our clients accountable to any contracts. Our customers can cancel at any time.
Exploitation
Clients are disallowed from exploiting services to modify settings of features beyond which they are permitted in their rental agreement. For instance, a client may not modify their slot count to an amount which differs from what they are renting from us.
Commerical Advertising Email (Spam) and Unsolicited Commerical Email (UCE)
You agree and understand that spamming, sending unsolicited emails from our servers or using email addresses that are maintained by us is STRICTLY prohibited and will qualify your Account for immediate deactivation with no refund. ServerCity would be the sole arbiter as to what constitutes a violation of this.
Liability Limitation and Exclusion
ServerCity, under no circumstances, shall be held liable for any data loss, disruption of information, or distribution of information including that of unauthorized access to our server systems or any other loss of data. ServerCity shall not be held liable for any disruption, delay, or disconnection of services for any period of time. We reserve the right to terminate a client's services in the event of a charge dispute, despite the outcome of the dispute.
Support
Any support requests required for products from ServerCity shall be submitted through the billing system via tickets or a ticket created via our discord server. Any other form of contact other than the predetermined ticket system is not guaranteed a proper answer from an official representative.
Promotions
ServerCity cannot guarantee that all promotion codes will work all of the time.
Legal Contact
ServerCity retains the right to seek and consult with any appropriate authorities that may need to be involved in the event of an issue arising whether it is through violation of this policy or any other illegal occurrence requiring involvement of law-enforcement agencies. ServerCity regards any communication between parties as confidential, upon distribution of any communication, unless prior approval is in place, we will take action to the full extent of the law. By purchasing a server from ServerCity you permit us to modify your server, this includes, but is not limited to, changing settings, uploading/mods, and other tasks related to running any server. Any verbal or written action to compromise our server systems or any other equipment owned by ServerCity will be taken seriously and will result in further investigation and possible lawsuits. Upon cancellation of payments to ServerCity your server will be suspended unless prior arrangements are made. Files will be kept as long as possible after termination or suspension however the guaranteed amount of time is unspecified. ServerCity retains the sole right to stop, start, and modify your server at any given time.
Unlimited Policy
While we offer unlimited bandwidth and space to our customers we reserve the right to request that you delete or delete ourselves excessive file such as large logs or anything else we deem excessive. Any uploaded files that cause the server to lag or make the server unplayable are not the responsibility of ServerCity. Unfair usage If we find your server using any sort of system to bypass limits put on your server such as slots or RAM amount your server is subject to being terminated without a refund.
Termination
We reserve all rights to terminate your server or service upon any violation of these terms or any other basis if deemed needed. Services which are suspended for non-payment will be terminated 3 days after the renewal invoice is due. We do not terminate services without cause.
Affiliate Comissions
ServerCity offers an affiliate program which will provide you with the opportunity to receive a 10% recurring comission on referred signups. This payout is contingent upon referred signups being genuine, new sales leads. Whether or not the referred signups are genuine is solely at our discretion. An example of an ingenuine referral would be affiliate traffic from a coupon directory which customers would only be visiting during the time of their order (which has already been initiated).

ServerCity may collect and use our users' personal information for the following purposes:
- To improve our site; we continually strive to improve our website offerings based on the information and feedback we receive from you.
- To send periodic and marketing emails (if the client has opted-in to receive them).
- To personalize the user experience; we may use information in the aggregate to understand how our users as a group use the services and resources provided on our site and services.
- To perform automated anti-fraud checks prior to purchase.
- To respond to user inquiries and requests for information. This data includes registrations for online newsletters, opt-in mailing lists and specific requests for further information.
- To respond to law enforcement organizations, government officials, third parties when compelled by subpoena, court order, or applicable law, or to report or prevent suspected fraudulent or illegal activity in the use of the Services. ServerCity will notify Customer of the information request or submission as, and if, allowed.

If a User no longer has an active service and wishes to have all of their information deleted, they reserve their right to request that all such data is removed from our systems.
How We Protect Your Information
We adopt appropriate data collection, storage and processing practices and security measures to protect against unauthorized access, alteration, disclosure or destruction of your personal information, username, password, transaction information and data stored on our Site.
